Storefront Terms of Service

Welcome. This storefront is operated by MDside AI LLC ("MDside", "we") on behalf of the healthcare clinic named on this store (the "Clinic"). The Clinic is the seller of the products offered here and the healthcare provider responsible for your care; MDside provides the technology platform. By creating an account or placing an order you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old, located in the United States in a state this store serves, and ordering for yourself. Accounts are personal: sign-in is by one-time email code, and you are responsible for activity under your email address.

2. How ordering works

Some products require review and approval by a licensed healthcare provider before they can be fulfilled:

  1. You add products to your cart and check out, completing a health questionnaire and accepting the Telehealth Consent.
  2. A provider licensed in your state reviews your request asynchronously. The provider may approve it, decline it, or request more information - if information is requested, your order is paused until you respond.
  3. If approved, your order is fulfilled; if declined, it is not, and you will be refunded per Section 4.

Approval is not guaranteed. The provider's decision is a clinical judgment we do not control, and neither MDside nor the Clinic promises any particular outcome. Do not rely on a pending order for any health need.

3. Your responsibilities

  • Answer the health questionnaire truthfully and completely. Inaccurate answers can lead to clinically inappropriate decisions and are grounds for declining or cancelling orders and closing your account.
  • Use products only as directed and per the accompanying materials; contact the Clinic with medical questions about your order.
  • Do not order on behalf of others, resell products, or misrepresent your state of residence.

This is not emergency care. If you have a medical emergency, call 911.

4. Prices, payment, refunds

  • Prices, taxes, and any fees are shown at checkout. Payment is processed by our payment processor ([Stripe]); we do not store your card number.

6. Acceptable use

Do not misuse the storefront: no unauthorized access, scraping, interference with operation, false identities, or unlawful use. We may suspend or close accounts that violate these Terms, and the Clinic may decline to serve you where permitted by law.

7. Disclaimers

THE STOREFRONT AND PLATFORM ARE PROVIDED "AS IS". TO THE EXTENT PERMITTED BY LAW, MDSIDE DISCLAIMS ALL IMPLIED WARRANTIES. MDSIDE IS A TECHNOLOGY PLATFORM: IT DOES NOT PRACTICE MEDICINE AND IS NOT RESPONSIBLE FOR THE CLINIC'S OR ANY PROVIDER'S CARE DECISIONS. NOTHING IN THESE TERMS LIMITS RIGHTS YOU HAVE UNDER CONSUMER PROTECTION LAW THAT CANNOT BE WAIVED.

8. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, MDSIDE'S AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE STOREFRONT IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID THROUGH THE STOREFRONT IN THE 12 MONTHS BEFORE THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND DOES NOT APPLY TO PROFESSIONAL LIABILITY OF THE CLINIC OR PROVIDERS, WHICH THESE TERMS DO NOT ADDRESS.

9. Disputes
